Creditor: Moultrie Jiu-Jitsu Academy (MJJA), located at 316 N Main St Moultrie, Ga 31768, OR Sylvester Jiu-Jitsu Academy (SJJA), located at 101B N Washington St Sylvester, Ga 31791

Agreement: Upon the execution of this Membership Agreement, the Parties agree to the terms and conditions set forth herein.

A. Membership Purchase: Member purchases and MJJA/SJJA sells on the Agreement Date for stated monthly payment, lessons in the martial arts for a minimum of two (2) lessons per week and without a maximum number of lessons per week. Lesson schedules for each particular class will be set at MJJA’s sole discretion. Prepayment: You may prepay three (3) or six (6) months in advance, for a discount of 10%.  However, there will be no refunds for unused portions of membership.

B. Promise to Pay: Member promises to pay MJJA/SJJA the payment schedule shown above. Payments shall be made payable MJJA and forwarded to MJJA/SJJA’s notice address as provided in Paragraph I(A) above.

C. Terms of Membership: Membership entitles Member to lessons as shown in Paragraph II(A) above until such time as member provides thirty (30) days written notification of desire for termination of membership.

D. Refunds: All fees are non-refundable except as provided herein. Failure to use the membership and utilize the facilities does not relieve the Member’s liability for payment until thirty (30) days after receipt by MJJA of written notification of termination.

E. Notices: Whenever any notice, demand, or request is required or permitted hereunder, such notice, demand or request shall be hand-delivered in person or sent by United States Mail, registered or certified, postage prepaid to the address provided above in Paragraph I(A).

F. Guardians: Parents and/or guardians are required to sign this Agreement on behalf of themselves individually and the minor and, by such bind the minor and themselves to the terms and conditions set forth herein.

G. Termination: The Agreement may be canceled by giving MJJA/SJJA written notice thirty (30) days prior to student discontinuing classes. MJJA may terminate or revoke the membership privileges of Member without prejudice if:
     Member fails to make payments as stated above
     Member violates a usage of safety rule regulation
     Member violates any rule of regulation

H. Martial Arts Belts: Member hereby acknowledges that official martial arts belt recognition is not guaranteed by MJJA/SJJA. Said official belt recognition will only be issued upon Member’s successful completion of required classes and the examination as assessed and evaluated by MJJA/SJJA personnel in their sole discretion.

I. Compliance with Rules and Conduct: Member agrees to be subject to the control of guidance and MJJA staff and instructors while on Premises and will follow instructions of MJJA/SJJA personnel.

J. Holidays: MJJA/SJJA at it’s sole discretion may declare holidays in which the Premises will not be open. This will include any day that MJJA/SJJA declares a holiday not to exceed thirty (30) days per calendar year.

This warning, waiver of claims and indemnity agreement must be read and signed prior to participation by all Members (and by their parent(s) or guardian(s), if the Member is a minor) who wish to participate in Moultrie Jiu-Jitsu Academy’s, or Sylvester Jiu-Jitsu Academy's classes, practice sessions, clinics, etc.

I, THE UNDERSIGNED DO HEREBY:

Agree that every time prior to participating in Martial Arts (as defined below) at MJJA’s Premises located at 316 N Main St Moultrie Ga 31768 OR SJJA's Premises located at 101B N Washington St Sylvester Ga 31791 (“Premises”) or at Martial Art events away from the Premises, I will inspect the mats equipment, facilities and if I believe anything is unsafe beyond my capability, I will immediately advise the supervisor of such condition(s) and refuse to participate.

Acknowledge and fully understand that the Martial Art activities in general (collectively “Martial Art” or “Martial Arts”) are physical contact exercises and that I will be engaging in activities that may result in serious injury, including death and property damage due not only to my own actions, inactions, and/or negligence, but also to that of others. Further, I acknowledge that there may be risks not known to me and/or not reasonably foreseeable.

Personally assume all risks involved in Martial Arts.

Enter into the Premises and all Martial Arts classes, practices, demonstrations, training and competitions at or away from the Premises entirely on my own free will and understand the importance of following rules established by MJJA/SJJJA’s supervisor(s), my instructor(s), coach(s), and other officials, and agree to follow those rules.

Certify that I am in good physical condition and have no disease, injury, or other condition that would impair my performance or mental well-being by such intense physical practice and training and harm, injure, or threaten the physical/mental well-being of others.

Grant permission in case of injury to have a supervisor(s), instructor(s), coach(s), participant(s), doctor(s), nurse(s), athletic trainer(s), or anyone else provide me with medical assistance and/or treatment for such injury.

Acknowledge that the Martial Arts techniques I learn are potentially dangerous and could result in serious injury, including death, to myself and/or others. I hereby forever release waive, discharge, and covenant not to sue Moultrie Jiu-Jitsu Academy, it’s principals, staff, directors, agents, coaches, other Moultrie Jiu-Jitsu Academy coaches, sponsoring agencies or any other individuals and/or entities, for any and all injuries, including death and damage(s) incurred while in or entering the Premises or while participating in: classes, practices, demonstrations, training, and competitions at or away from the Premises. I further agree to indemnify and hold Moultrie Jiu-Jitsu Academy, it’s principals, my instructors/supervisors, and any other Moultrie Jiu-Jitsu Academy employee harmless from and against any and all claims, liabilities, and damages which may result from my use of the Martial Arts techniques or someone else’s use of the Martial Arts upon me.

I, as an Adult (as defined by state and local laws), do hereby agree to all conditions set forth above and accept their ramifications, and I additionally confirm and agree to all of the above statements, conditions, waivers, releases, indemnifications, and consent to participate under the above conditions.

In case of a minor: I/We the parent(s), or legal guardian(s) of this minor have instructed the minor of the provisions hereof and their ramifications and hereby consent to this minor’s participation. I/We additionally confirm and agree to all and adopt and ratify as my/our own all of the rules, regulations, representations, waivers, releases, indemnities, etc., included herein.

I/WE HAVE READ THE ABOVE, UNDERSTAND THAT I/WE AM/ARE GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS, AND I/WE, KNOWING THIS, ENTER INTO AND SIGN IT VOLUNTARILY.
